These Terms & Conditions ("Terms") govern (i) your use of www.rustyfields.com (the "Website"), (ii) your access to and play on the RustyFields Rust game server (the "Server"), and (iii) your purchase of any digital goods, ranks, perks, kits, access, subscriptions, or other benefits intended for use on the Server (the "Store" and "Digital Items").

By using the Website/Server or placing an order, you agree to these Terms. If you do not agree, do not use the Website/Server and do not purchase from the Store.

2. Third-Party Notice (Rust / Steam / Discord)

The Server is a community server. We are not affiliated with, endorsed by, or sponsored by Facepunch Studios, Valve Corporation/Steam, Discord Inc., or any other third party. "Rust," "Steam," "Discord," and other marks belong to their respective owners.

Your ability to access the Server depends on third-party services (game client, Steam services, hosting providers, networking infrastructure, etc.) ("Ancillary Services"). We are not responsible for third-party outages, bans, account actions, or service changes beyond our control.

3. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction, if higher) to purchase from the Store. Minors between 16 and 18 represent that they have parental or guardian consent. You must be legally able to enter into these Terms.

In accordance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us personal information, please contact us immediately at [email protected] so we can delete it.

4. Accounts / Identifiers / Security

You must provide accurate identifiers (e.g., SteamID, in-game name, Discord ID, email address) at checkout. Delivery is tied to the identifier(s) you provide.

You are solely responsible for:

• Maintaining access to your accounts;
• Keeping your credentials secure;
• All activity that occurs under your accounts.

We are not liable for losses caused by unauthorized access to your accounts through no fault of ours.

5. Server Rules, Moderation, and Enforcement

You must follow our Server rules and all applicable third-party platform and game rules.

We reserve the right to warn, mute, kick, suspend, wipe, reset, remove items, or ban accounts at our reasonable discretion to protect the community and integrity of the Server.

Purchases do not grant immunity from enforcement. A ban or suspension resulting from a violation of rules does not entitle you to a refund.

6. Digital Items — Licensed, Not Sold

Digital Items are licensed, not sold. You receive a limited, revocable, non-transferable, non-exclusive license to use the Digital Items on the Server for personal, non-commercial use, tied to the account/identifier used at purchase.

You may not resell, transfer, gift, trade, share, or sublicense Digital Items unless we explicitly allow it in writing.

Digital Items (including any "virtual currency," credits, tokens, points, ranks, kits, perks, etc.) have no real-world monetary value, are not redeemable for cash, and cannot be exchanged for real-world goods or services.

7. Payment Processing

We use Stripe, Inc. and/or other third-party payment processors ("Payment Processors") to process transactions. When you make a purchase:

• Your payment information is collected and processed directly by the Payment Processor; we do not store your full payment card details.
• BellaExports, LLC is the merchant of record and the contracting party for your purchase.
• By making a purchase, you also agree to the Payment Processor's terms of service.

8. Order Process and Acceptance

An order is an offer to purchase. A purchase is accepted when we and/or the Payment Processor confirms the order and fulfills the Digital Items.

We reserve the right to refuse, cancel, limit, or delay orders for any reason, including but not limited to:

• Suspected fraud or abuse;
• Chargeback risk;
• Pricing or technical errors;
• Violation of these Terms or Server rules;
• Exceeding reasonable purchase quantities.

If we cancel an order after payment has been collected, we will issue a full refund of the purchase price.

9. Pricing, Taxes, and Billing

• Prices are displayed at checkout in U.S. Dollars (USD) unless otherwise stated.
• Applicable taxes (sales tax, use tax, VAT, or similar) may be added based on your location as required by law.
• You agree not to use VPNs, proxies, or other methods to misrepresent your location to circumvent pricing, tax obligations, or geographic restrictions.
• Your bank or payment provider may charge additional fees (e.g., currency conversion); those are your responsibility.

10. Delivery, Wipes, and Changes

Delivery: Digital Items are typically delivered automatically and may be instant. Delivery can be delayed by verification, server outages, game wipes, updates, or third-party issues.

Server Changes: The Server may undergo wipes, resets, rebalancing, renaming, feature changes, or discontinuation at any time. Digital Items may be affected by wipes, balancing, or rule changes. We do not guarantee any specific duration, power level, or perpetual availability of benefits.

If delivery fails due to our error and we cannot resolve it within a reasonable time, our remedy may include: re-delivery, replacement, store credit, or refund — unless applicable law requires a specific remedy.

11. Virtual Currency and Abuse Monitoring

If a purchase includes virtual currency, credits, or tokens, we may monitor purchase and use patterns to detect fraud, exploitation, or abuse. We may investigate unusual activity and may revoke or forfeit virtual currency and related benefits for:

• Fraud or unauthorized transactions;
• Exploitation of bugs or duplication glitches;
• Chargeback abuse;
• Violation of these Terms or Server rules.

12. Refund Policy

No refunds or credits will be provided solely because:

1. You were banned, suspended, or lost access to an account or Ancillary Service due to a rules violation;
2. The Server rules changed, the Server wiped, or gameplay balancing was adjusted;
3. You changed your mind or no longer want or need the item;
4. Your device, network, or software is incompatible, or you cannot access third-party services.

Exceptions: If we are unable to deliver a purchased item due to our error, or if applicable law provides you with a right to a remedy, we will work with you to resolve the issue.

13. Subscriptions and Auto-Renewal

If we offer subscription-based Digital Items:

• Recurring billing: Subscriptions renew automatically at the price and frequency disclosed at checkout until cancelled.
• Cancellation: You can cancel at any time using the cancellation method provided in your receipt email and/or your billing portal.
• Ease of cancellation: You may cancel through the same method used to subscribe.
• Effect of cancellation: Cancellation stops future renewals. Previously paid periods are non-refundable except where required by law. You retain access through the end of the current billing period.
• Price changes: If we change subscription pricing, we will notify you in advance.

Our subscription practices comply with the Restore Online Shoppers' Confidence Act (ROSCA), 15 U.S.C. §§ 8401–8405, and applicable state auto-renewal laws.

14. Chargebacks and Payment Disputes

Before filing a chargeback or payment dispute, please contact us at [email protected] so we can attempt to resolve the issue directly.

If you initiate a chargeback or payment dispute:

• We may suspend or remove the associated Digital Items and restrict future purchases.
• Fraudulent disputes may result in permanent bans from the Server and Store.
• We reserve the right to contest any chargeback we believe to be illegitimate.

15. Acceptable Use

You may not:

• Cheat, exploit bugs, duplicate items, or use unauthorized software or modifications;
• Harass, threaten, dox, impersonate, or abuse other users;
• Reverse engineer, decompile, or interfere with the Website, Store, or delivery systems;
• Attack or disrupt services (including DDoS or similar attacks);
• Use stolen, unauthorized, or fraudulent payment methods;
• Use automated purchasing tools, bots, or scripts;
• Violate any applicable federal, state, or local law.

16. Intellectual Property

All content on the Website is owned by or licensed to BellaExports, LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

17. Privacy and Data Collection

Your use of the Website, Server, and Store is also governed by our Privacy Policy. By using our services, you acknowledge that you have read and understand our Privacy Policy.

We collect certain personal information (such as email address, name, billing address, SteamID, and Discord ID) necessary to fulfill orders and operate our services, in accordance with applicable privacy laws including the Florida Information Protection Act (FIPA).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud, willful misconduct, or death or personal injury caused by our negligence.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BellaExports, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your use of or access to the Website, Server, or Store;
• Your violation of these Terms;
• Your violation of any third-party rights;
• Your violation of any applicable law or regulation.

21. Dispute Resolution

Informal Resolution First

Before initiating any formal legal proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles.

Venue

Unless prohibited by mandatory consumer protection law in your jurisdiction, any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you hereby consent to the personal jurisdiction of such courts.

22. Changes to These Terms

We may update these Terms at any time by posting a revised version on the Website with an updated "Last Updated" date. The Terms in effect at the time of your purchase apply to that transaction.

For material changes that may affect your rights, we will make reasonable efforts to notify you (such as a notice on the Website or by email).

Continued use of the Website, Server, or Store after changes are posted constitutes your acceptance of the updated Terms.

23. Miscellaneous

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
• No Waiver: Our failure to enforce any provision is not a waiver of that provision.
• Assignment: We may assign these Terms without restriction. You may not assign without our prior written consent.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BellaExports, LLC.
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (acts of God, war, government actions, internet disruptions, third-party outages, etc.).
• Electronic Communications: By using the Website or Store, you consent to receiving electronic communications from us.
